01Who We Are & What This Covers
This Privacy Policy explains how Sew Smart AI, LLC ("Sew Smart," "we," "us") collects, uses, and shares information in connection with the Sew Smart Dealers platform, the Dealer Portal (app.sewsmart.ai), the AI assistant/chatbot, the in-store app, and our website (together, the "Services"). By using the Services, you agree to this Policy. This Policy works alongside our Terms & Conditions.
02Whose Information This Policy Addresses
The Services involve two groups of people, and our role differs for each:
- Dealers and their staff — the businesses and individuals who subscribe to and use the platform and Dealer Portal. For this information, Sew Smart acts as the party responsible for the data (the "controller").
- A dealer's own customers — the people who interact with the AI assistant on a dealer's website or in-store devices. For those conversations, Sew Smart acts as a service provider processing information on the dealer's behalf. The dealer is responsible for its own privacy notices to its customers.
03Information We Collect
Information you provide to us
When you subscribe, onboard, or use the Dealer Portal, we collect information such as your business name, website, address, store hours, the brands and product categories you carry, your logo and branding, contact names, email addresses, and phone numbers, and the business information you supply to configure your assistant.
Assistant conversations
When someone interacts with the AI assistant, we collect the questions and messages they submit and the responses generated, so the assistant can provide answers and so we can maintain and improve the quality of the Services. We do not require or ask end users to submit personally identifiable information; any personal information is collected only if a user voluntarily enters it (for example, in a lead or contact form).
Account & billing information
We collect the information needed to manage your subscription and process payments. Payment card details are handled by our payment processor; we do not store full card numbers.
Automatically collected information
Like most online services, we automatically collect limited technical and usage information — such as IP address, device and browser type, pages viewed, and interactions with the platform — through cookies and similar technologies (see Section 8).
04How We Use Information
We use information to:
- Provide, configure, operate, and support the platform and your AI assistant;
- Generate helpful responses and create the marketing and event content you request;
- Maintain, secure, troubleshoot, and improve the quality and accuracy of the Services;
- Process payments and manage your subscription;
- Communicate with you about your account, updates, and support; and
- Comply with legal obligations and enforce our Terms.
We may use aggregated or de-identified information (which does not identify you or any individual) to analyze and improve the Services.
05AI Processing & Third-Party Providers
The assistant is powered in part by licensed third-party artificial intelligence models, including those provided by OpenAI. When a user interacts with the assistant, the content of that interaction may be transmitted to and processed by these AI providers to generate a response, subject to their terms and privacy commitments. We also rely on trusted third-party infrastructure, hosting, and marketing/CRM providers to deliver the Services. These providers may process information only to perform services for us and are not permitted to use it for their own purposes.
06How We Share Information
We do not sell or rent your information or your customers' information. We share information only in these limited situations:
- Service providers. With the third-party providers described in Section 5, who help us operate the Services under confidentiality obligations.
- With your direction. Information you ask us to share or that is inherent in a feature you use (for example, lead information captured through your assistant is made available to you, the dealer).
- Legal reasons. When required by law, subpoena, or legal process, or to protect the rights, safety, and security of Sew Smart, our users, or others.
- Business transfers. In connection with a merger, acquisition, financing, or sale of assets, information may be transferred as part of that transaction.
07Dealer-Customer Data & Dealer Responsibilities
When we process conversations between the assistant and a dealer's customers, we do so on the dealer's behalf and use that information to provide and improve the Services. The dealer is responsible for how it deploys the assistant and for providing any privacy notices or obtaining any consents required by law for its own customers. Dealers should not configure the assistant to solicit sensitive personal information (such as financial account, health, or government-ID numbers).
08Cookies & Tracking
We and our providers use cookies and similar technologies to keep you signed in, remember preferences, operate the assistant, and understand how the Services are used. You can control cookies through your browser settings; disabling some cookies may affect how the Services function.
09Data Retention
We keep information for as long as needed to provide the Services, maintain your account, comply with our legal obligations, resolve disputes, and enforce our agreements. If your subscription ends, we will delete or de-identify client-specific data after a reasonable period, unless we are required by law to retain it. You are responsible for exporting any data you wish to keep before your subscription ends.
10Security
We use commercially reasonable administrative, technical, and organizational safeguards designed to protect information against unauthorized access, loss, or misuse, and we apply access controls internally. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. You are responsible for keeping your account credentials confidential.
11Your Choices & Rights
You may review and update your business and account information, or request that we correct or delete information, by contacting us at support@sewsmart.ai. Depending on where you live, you may have rights to access, correct, delete, or restrict the use of your personal information, and to opt out of certain processing.
California residents. We do not sell personal information. If you are a California resident, you may have additional rights under the California Consumer Privacy Act (CCPA/CPRA), including the right to know, delete, and correct personal information and to not be discriminated against for exercising those rights. To make a request, contact us using the details below.
Requests made on behalf of a dealer's own customers should be directed to that dealer; we will assist the dealer as their service provider.
12Children's Privacy
The Services are intended for businesses and are not directed to children under 13, and we do not knowingly collect personal information from children. If you believe a child has provided us information, please contact us and we will delete it.
13U.S.-Based Services
The Services are operated in the United States and intended for users in the United States. If you access the Services from outside the U.S., you understand that your information will be processed in the United States.
14Changes to This Policy
We may update this Privacy Policy from time to time. We will post the updated version with a new "Last updated" date and, where appropriate, notify you. Your continued use of the Services after changes take effect constitutes acceptance.
